In response to your e-mail of this date, you may locate the Hawaii Appellate Court's decision on their web site www.state.hi.us/jud. When you get into that link, at the top will be several markers. Click on the one marked "Opinions". After you have the Opinions link opened, click on the tab marked November for the year 1998. That will bring you to a list of all the decisions in that month.

Scroll down to November 17, 1998 and you will see the Golden Budha (Roxas ) case. Highlighted in red is the number 20606. If you click on that number, it will bring up the entire decision. Please be advised that the decision is about 140 pages long.

When you are on the main index screen (before you clicked on the number 20606), you will note that there was an amendment to the verdict, and you can click on that link as well.

Roxas' attorneys filed a Motion for Reconsideration asking the Court to reconsider their verdict and reversal. The Court denied the Motion for Reconsideration on 1/28/99.

I am a licensed private/legal investigator. For almost 7 years I worked for the law firm who represented Rogelio Roxas and the Golden Budha (sic) corporation in their litigation against the Marcoses. I conducted all the investigation on the Roxas case and worked for the firm until July 19, 1996, the day the verdict was returned in Hawaii.

You may wish to update your chronology to show that on November 17, 1998 (pursuant to an appeal filed by counsel for Imelda Marcos), the Hawaii Supreme Court found in her favor and overturned the vast majority of the $22 billion verdict. The Hawaii Supreme Court remanded the case back to the trial court for a new trial on the limited question of the proper worth of the buddha. According to published reports, the Court found the evidence relative to the gold bullion allegedly found in underground tunnels to be too speculative as to the amount of gold and the value of same, and therefore disallowed same. Trial on the issue of the buddh'a value is due to commence in February of 2000 in Hawaii. You can read a copy of this published appellate decision on the Internet for more information.

As I had met and/or spoken to a good number of the people mentioned in your chronology, and have personal knowledge of many of the facts contained therein, I found your summary quite interesting and well stated.

Were you there or did you know who gave the ingredients to blow the vault of the Central Bank of the Philippines?

And, were the books of Marcos accounts really cooked?

And, were the accounts only Marcos'? Or, did anyone else, lose documents of gold bullion certificates; like the Philippine Government herself; legally seized and acquired as the spoils of war from Japanese prisoners killed for their knowledge by not only the dishonorable Mr. Marcos but by other honorable officers of the Philippines elite during the biggest bank heist in world history?

And, was General MacCarthur also looking to acquire some of the same spoils of gold and documents seiged (sic) and spoils by the Japanese, as they ransacked all of China, Hong Kong ( England of her Majesty ) and Cambodia of their wealth?

Does Imelda or Bongbong Marcos really know how much money they really have?

The C.I.A. did well in keeping this secret hidden and Marcos left the Philippines escorted by the U.S. into Hawaii very ill; knowing that documents of his wealth slipped through his fingers into wrongful hands (trusted officers) whom he personally gave the order for his shipment of goods to follow him into Hawaii; but, the order being given, his order became illfully (sic) void as his shipments were whisked away from the rooftop of the CBP to all parts of the Philippines; believe it or not?.

Mr. Marcos was whisked away to Hawaii within the hour, after giving his military order from Malacanang as they were about to be overran by the Aquino Revolutionaries known as "People Power" and Mr. Marcos was flown out. With the order given and the C.I.A. supervising; the plan to blow the vault or vaults became into play and within a few days 13 helicopters landed on the rooftop the Central Bank of the Philippines and the greatest robbery in world history took place and Mr. Ferdinand Marcos knew his vast wealth was gone and would become terribly ill, as he knew, documented accounts of his vaults around the world did not follow him but went. into all parts of the Philippine Islands? Believe it or not ?

Then why is the U.S. trying to extradite the Australian lawyer Mr. Jacobi who is helping the Philippines PCGG and the Blue Ribbon Committee for his information of Swiss Accounts when other knowingly existed with the C.I.A. were overseers of the bank heist that took place or some C.I.A. agents did see the robbery taking place but did not get to personally see the documents being heisted and flown to all parts of the Philippines? And, what happened to all the gold bars at the end of the runway of the Philippines International Airport when a Senator of the Philippines tried to leave the airport runway with his gold bullions but could not leave the runway because he did not stow his gold bars evenly inside in the middle of the plane and crashed the plane because it did not lift off the ground because of the unbearable or improperly stowed load of gold? Believe or not?

Thank you for your excellent work. I believe the information you have provided is most helpfull and probably very accurate. I believe the source of most of the Marcos wealth was the treasure found by Roger Roxas in January 1971. Our proof was the testimony of witnesses who saw the gold bullion and contracts signed by Marcos where he was offering to sell $1,636 trillion to various parties.

I hope, like you, that the truth will eventually come out. Thank you again.

The contracts (9) that Marcos entered into with Remington (Doel and O'Brien) totaled $1.636 trillion when the gold was evaluated at $400 per oz. The contracts specified the purity at .999. Our witnesses saw the bullion.

The only crying shame about Ferdinand Marcos and this so called greatest loot in history is not WHAT Marcos and his cronies did but THAT Pilipinos let them do it!!! Marcos was just one of a long line of "compradors" who have looted our country for centuries. Leeches who have infested the islands for decades include famous and respected old-names like the Ayalas, Sorianos, Zobel, Lopez, Cojuanco, Aquino, Osmena and Elizalde as well as relatively new ones like Gokongwei, Sy, (Lucio) Tan and Tan Yu. To be more comprehensive, Charlie Avila must also include the story of the former Spanish monopoly Tabacalera, the land-rich Catholic church and the entrenched Spanish elite. He must explore the relationships between the MacArthurs, McMickings, Sorianos, Ayalas and Zobels. He can tell us about how Quezon and Osmeņa competed as American cronies during the Commonwealth era, and how they separately "negotiated" a sham independence. He can relate the feudal rivalry between the Aquinos and Cojuancos of Tarlac. He can tell why Lucio Tan, an owner of a mid-size tobacco company, was able to hijack our national airline fleet--and why, after gross mismanagement of PAL, he's still in control of this national resource. He can also inform us how Mall King Henry Sy pulled the rabbit out of the hat and magically tranformed his small shoe store at Carriedo into the Megamalls of Metro-Manila. Certainly, Charlie can research in Taiwan how Tan Yu's Asia World Resort flourished while Marcos brutally ransacked the Philippines. Now tell us about Joe de Venecia and his lands in Pangasinan, or Ponz Enrile and Jollybee.

Marcos is long gone but these personalities still haunt our tragic islands. Why??? Is it that only within our happy and friendly shores can we find people who are so joyful, tolerant and forgiving that the brutal dictator's son and widow were welcomed back with open arms and awarded fiefdom over Ilocos and Leyte? Last September 21st while a record number of people spilled out into the streets to mourn the anniversary of Marcos' Martial Law, many gathered in a "Thanksgiving" mass to pray for their beloved oppressor and dictator.

They baaackk!!! Like in the movie Poltergeist, Marcos' cronies are back. Like in the movie Groundhog Day, Pilipinos keep on re-living their own nightmare. For some reason, Pilipinos seem to enjoy nightmares and tyrants. Fidel Ramos, one of the plotters who ushered Marcos' period of infamy, eventually became the President of the "restored" Republic. Erap, Imelda Marcos' trusty lieutenant in San Juan, followed the brutal constabulary chief. With the Cojuanco financed Erap at the helm, it's the good old days once again. Remember United Coconut Planters Bank? What about his guy Zamora? Pilipinos can certainly give new meaning to "trash recycling" and "historical whitewashing". It's truly wonderful! A new generation of Agoncillos and Zaides have inherited their elders' historical myopia. Today, Pilipino school children could hardly relate to the events that followed September 21, 1972--condemned to repeat the sins of their elders.

No! We do not struggle economically because of Marcos and his loot--he's long dead, just in case nobody notice. Japan recovered from utter devastation in World War II in about as much time. We do not need any extensive research like Charlie Avila's to prove what's been obvious for a long time before Marcos. (As if Marcos pulled off his magical feat while we were all asleep and hypnotized) All we need to do is look at ourselves in the mirror. Alas, we'll realize that we deserve the tyrants we nurture and breed.

Hello Gil,

You must be confusing me for someone else. I'm dull as a door knob,it's very hard to elicit any passion from me. I agree with much of your report. However, I find your conclusions incredulous--especially the analogy of Pilipinos as rape victims. Fool me once, then it's shame on you. Fool me twice, then it's shame on me. Fool me again and again, then I'm truly the wretched of the earth, deserving eternal damnation.

You make it sound like "consistent acceptable evidence" are hard to come by. What resources do you need? Where were you these past years? If you base your research on the whitewashed Philippine History that had been taught to Pilipinos since nineteen-kopong-kopong, then you're in for a wild goose chase. Now, if live as a Pilipino with your eyes wide open, then there might still hope for you and your work.

May I suggest that you spend much of your passion traveling the Philippine countryside and Pilipino diaspora communities abroad. Find out how enlightened or indifferent they are with the situation in our country. When you're done, tell me squarely and honestly if you cannot conclude that Pilipinos only deserve the tyranny that they breed.

Don't get me wrong, I applaud your work. However, your motivation, conclusion and comments just reinforce the sad impression I have of the country's future. If more enlightened people like you, think and act this way then what should we expect from the rest of the country. The burden of oppression rest squarely on the shoulders of the oppressed. Redemption is not handed over on a silver platter. We must learn to stop to blaming others and seize our own destiny. Our glory rests in no other hands but ours.

Some try mightily to grope for a way into a transient or permanent global diaspora.

Most don't have a candle, a match, much more any means to get hold of dynamite even if they have a mind to.

The rest are barely surviving and are almost in a catatonic state.

I saved Gil's e-mail, so I could respond to him later when I get the chance. Since you have shared our private exchange, I will reluctantly respond to this list. For what it's worth, here is my quick response. It's interesting that Gil listed the above options for Pilipinos. Where do I belong? I lived through all these options. I was kept in the dark but saw through the light. I lit up candles but most Pilipinos prefer to live in darkness. My dynamites still await the conflagration. And yes, I'm also part of the global diaspora. Despite all the nice options available to me, I sometimes wonder, why do I bother to come back to my homeland that never was? Why do I even participate in these discussions?

Even if they have the mind to??? Do you really believe this? If we "have the mind to", we would have been the the shining Pearl of Asia. Japan and Korea rose from the ashes of World War II, with much less candles, matches or dynamites. This comment make it sound like most Pilipinos are pathetically helpless. In our country, while a few mothers weep for their tortured sons and daughters, most Pilipinos prefer to look the other way--they are too preoccupied with shopping malls, American movies and Pilipino komiks. If we "have the mind to", no army on earth can cower the ambitions 50 million Pilipino souls.

I was in Korea a few months after the Asian economic collapse. Even though most Koreans were still well-off than the average Pilipino, they wore this shame like a scarlet letter on their chest. Meanwhile in our happy islands, the joyful leader Fidel Ramos who just saw his currency decimated to worthlessness, was all to happy to proclaim--like a child who was not caught with his hands in the cookie jar again--that we did nocaused the crisis ***this time***! This tells a lot about our national character. :(

There is no shortage of candles in our faithful land. Most adorn the altars of misplaced hopes, like that of the Caucasian Nazarene in Quiapo. At home, the blue-eyed messiah graces the Pilipino living room. There will be salvation--we were taught for centuries by our pale and blue-eyed colonial masters--for those who endure terrestial sorrow. For sure, many Pilipinos happily endure. You know why a thousand and one dynamites cannot spark a conflagration in our blessed islands? You know why a million points of candlelight shines like one bright, shining lie in eternal darkness? You might find your answer in the fatalism of our masses, the indifference of our middle-class and the greed of our aristocrats.

Many Pilipinos in the global diaspora still come back to the homeland. Many do their share through donations and activities with non-governmental organizations--we do this all the time, it's our hobby. Many hold their flickering light amidst the raging tropical storm. And yes, some do their research on all sorts of things from breastfeeding to the Marcos billions. Somehow this unreciprocated generosity will trickle to the most wretched. Some will be fed or healed. A few will be enlightened. However, our sad song will remain the same. Somehow, we stubbornly insist of taking the wrong medication for our ills.

Now, why spend a lot of time recovering a few paltry billions abroad when we can take back the trillions that are already in the country? Why spend a few moments applying false remedies to our malignant wound? Let's take back the whole country. If this requires a conflagration then let's start it now.
